Eligibility

To qualify for H-1B

The position must:

  • Be within an occupation with a theoretical and practical application of a body of highly specialized knowledge;

  • Require at least a U.S. bachelor’s or higher degree (or foreign equivalent degree) in a specific field of study;

  • Offer a wage no less than the prevailing wage set by the U.S. Department of Labor OR the actual wage (wage of comparable employees within the unit); whichever is higher.

The employee must:

  • Hold a U.S. bachelor’s or higher degree (or foreign equivalent degree) required by the position from an accredited college or university.

  • Hold an unrestricted state license, registration, or certification that authorizes to fully practice in the occupation if the position requires it.


* On September 19, 2025, a Presidential Proclamation was issued. Under the Proclamation, *new* H-1B petitions filed must be accompanied by an additional $100,000 payment as a condition of eligibility.

NOTE: *New* stands for H-1B petitions for employees who are outside the United States and would be entering on H-1B category.
