Eligibility

To qualify for H-1B

The position must:

Be within an occupation with a theoretical and practical application of a body of highly specialized knowledge;
Require at least a U.S. bachelor’s or higher degree (or foreign equivalent degree) in a specific field of study;
Offer a wage no less than the prevailing wage set by the U.S. Department of Labor OR the actual wage (wage of comparable employees within the unit); whichever is higher.

The employee must:

Hold a U.S. bachelor’s or higher degree (or foreign equivalent degree) required by the position from an accredited college or university.
Hold an unrestricted state license, registration, or certification that authorizes to fully practice in the occupation if the position requires it.

* On September 19, 2025, a Presidential Proclamation was issued. Under the Proclamation, *new* H-1B petitions filed must be accompanied by an additional $100,000 payment as a condition of eligibility.

NOTE: *New* stands for H-1B petitions for employees who are outside the United States and would be entering on H-1B category.
